WINE-SPECIFIC CONDITIONS

LEGAL REQUIREMENTS

You must be 21 years of age or older, to order or receive alcoholic beverages from Somerston Wine Co. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). Wines purchased from Somerston Wine Co. are not for resale, and are for personal consumption only.

CREDIT CARD CHARGES

Orders are by credit card only. We accept Visa, MasterCard, and American Express.

MINIMUM PURCHASE

No minimum purchase is required.

STATES AUTHORIZED FOR DIRECT SHIPMENT

Due to the ever-changing nature of wine shipping laws, we may be able to ship wines, directly or indirectly, to all states except AL, DE, KY, MS, OK, PA, SD, UT. 

SHIPPING COSTS

Federal Express Ground is Somerston Wine Co carrier of choice. Ground shipping is provided by Federal Express Ground at current market rates. *Note – If the customer selects Fed Ex Air as his or her carrier, the customer pays all shipping charges, regardless of his or her wine club membership or purchase amount.

WINE IS A DELICATE COMMODITY

Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. Somerston Wine Co. is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.

GIFT CARDS

Priest Ranch and Somerston gift cards are distributed by Somerston Wine Company, LLC (“SWC”).  Gift cards and these terms and conditions are governed by the laws of the State of California.  SWC reserves the right to changes these terms and conditions from time to time in its discretion.  Gift cards are redeemable at www.priestranch.com and www.somerstonwineco.com and are available for purchase on both of these web sites.  No fees of any kind will be imposed on purchasers or recipients of gift cards.  To redeem gift cards, please see instructions on our website, or use the gift card at our tasting room in Yountville, California.  To view your gift card balance, call (707) 967-8414.  You may not return or cancel your gift card after it is received.  Purchasers who wish to cancel a gift card purchase order prior to its delivery to a recipient should contact customer support, (707) 967-8414.  If you suspect that someone has copied or stolen your gift card, contact customer support immediately.  Gift cards will not be replaced if lost or stolen without proof of purchase.  Gift cards have cash value and should be safeguarded accordingly.  Limitations:  You may not use a gift card to purchase other gift cards.  Gift cards cannot be reloaded, resold, transferred for value, or redeemed for cash, except to the extent required by law.  Void if reloaded, resold, transferred for value or redeemed for cash.  Unused gift cards may not be transferred.  Gift cards are subject to SWC’s privacy policy, set forth in www.somerstonwineco.com.  Ownership and risk of loss of gift cards passes to the purchaser as soon as we send our confirmation to the recipient.  We are not responsible for lost or stolen gift cards.  If you have questions or need assistance, please contact customer service.  Please refer to your order number, or be ready to supply your email address.  Gift cards may be paid for with a valid VISA, MasterCard, American Express card, or cash.  We are not responsible for gift cards that are undeliverable or not received due to your failure to enter an accurate physical address or email address for the recipient.  Please check to make sure that the address of the recipient is correct and contact customer support if you suspect the recipient did not receive his/her gift card.  SWC AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  IF A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD.  CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES.  IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.  YOU HEREBY CONSENT THAT ANY DISPUTE RELATING IN ANY WAY TO SWC GIFT CARDS SHALL BE ADJUDICATED IN NAPA COUNTY, CALIFORNIA CALIFORNIA, AND YOU CONSENT TO EXCLUSIVE JURISDICTION AND VENUE IN SUCH COURTS.
